Fish Copilot (the “App”) — Last updated: March 27, 2026

These Terms of Use (“Terms”) govern your access to and use of the Fish Copilot mobile application and related services (collectively, the “Service”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Apple App Store and Apple’s Standard EULA

If you obtained the App through the Apple App Store, your use of the App is also subject to Apple’s Licensed Application End User License Agreement (“Apple EULA”) for apps licensed through the App Store. In the event of a conflict between these Terms and the Apple EULA as required by Apple, the Apple EULA will govern solely to the extent of that conflict.

Apple is not responsible for the App or its content, maintenance, or support, except as set forth in the Apple EULA. Apple has no obligation to furnish any maintenance or support services for the App.

2. Eligibility

You must be able to form a binding contract in your jurisdiction and at least 13 years old (or the minimum age required in your country) to use the Service. If you use the App on behalf of an organization, you represent that you have authority to bind that organization.

3. License to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial purposes on devices you own or control. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code from the App, except as allowed by applicable law.

4. Safety, navigation, and maps — not a substitute for proper equipment

Important: Fish Copilot is an informational and planning tool. It is not certified or intended as a primary means of navigation, collision avoidance, or pilotage.

You must not rely on the App, its maps, or any on-screen position or route information as a replacement for approved navigational tools.

Content in the App (including fishing forecasts, scores, tides, weather, and tips) is for general information only and is not professional maritime, legal, safety, or fishing advice. Always verify critical information with authoritative sources before acting.

Some features require an account. You are responsible for safeguarding your credentials and for activity under your account. You agree to provide accurate information and to notify us if you become aware of unauthorized use.

If you upload or sync content (such as photos, notes, waypoints, or tracks), you retain your rights in that content. You grant us a worldwide, non-exclusive license to host, store, process, and display that content solely to operate and improve the Service for you. You represent that you have the rights needed to grant this license.

9. Third-party services

The App may incorporate or link to third-party services (such as map providers, sign-in providers, and data sources). Your use of those services may be subject to their separate terms and privacy policies. We do not control third parties and are not responsible for their content or practices.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO USE THE SERVICE — INCLUDING ANY ON-WATER USE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (USD $100), IF YOU HAVE NOT PAID ANYTHING, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

12. Indemnity

You will defend, indemnify, and hold harmless us and our affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms.

13. Changes to the Service or Terms

We may modify the Service or these Terms at any time. We will post updated Terms on this page and update the “Last updated” date. Material changes may be communicated through the App or other reasonable means. Continued use after changes constitutes acceptance.

14. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or harms the Service or others. You may stop using the App at any time. Provisions that by their nature should survive will survive termination.

15. Governing law

These Terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence apply.
